Employers draw on the same algorithms — and outcomes cluster
Stanford Digital Economy Lab researchers examining algorithmic monoculture in hiring found that roughly 4% of applicants who applied to ten positions were recommended for rejection from all ten — a higher rate than chance alone would predict. The same work reports measurable adverse impact for Asian and Black applicants.

A class action asks whether AI scoring is a consumer report
In Kistler et al. v. Eightfold AI Inc., filed in January 2026, two California job applicants allege that the company collects applicant data and generates a hidden “likelihood of success” score that employers use to rank candidates.
The complaint alleges Eightfold operates as an unregistered consumer reporting agency under the FCRA and California’s ICRAA, without disclosure, access to the report, or a way to dispute inaccuracies.
